District statement on Nov. 10 court ruling on mask order

The Commonwealth Court on Wednesday, November 10, released its decision on a challenge to the Pennsylvania Department of Health Mask Order that took effect September 7. The decision can be viewed here.

The court ruled that the mask order is void because it was not adopted in compliance with the regulatory review process. Therefore, the order has been deemed unlawful.

As a result of this decision, the mask-optional policy in Penn Manor’s Health and Safety Plan for 2021-2022, adopted by the Penn Manor Board of School Directors, takes effect immediately. 

Absent a valid order, the plan states that mask wearing is not required in our schools or at district activities. It is acceptable, however, for those who wish to wear a facial covering to do so, regardless of vaccination status, in our schools and at district activities. 

We understand that this court decision may be appealed, and we will continue to share information as it becomes available.

This PA court decision does not impact the federal mandate requiring face coverings on school buses.
