Numerous federal and state laws require school districts to provide students, parents, and/or the public with notices. The documents below will help you to better understand your rights. Penn Manor invites parents and guardians of students to review the following information. Asbestos Hazard Emergency Response Act (AHERA)

As required by the Asbestos Hazard Emergency Response Act (AHERA), the District has maintained a Management Plan including Periodic Surveillance as stipulated in the Environmental Protection Agency’s AHERA Regulations, Section 763.84. Re-inspection of our buildings is a regular part of our continuing Asbestos Management Plan.
If you wish to obtain a copy of the Management Plan, a copy will be furnished within thirty days of receipt of a written request at the cost of reproduction, total cost to be paid in advance. Child Nutrition/Wellness Programs

Penn Manor School District recognizes that students require adequate, nourishing food and beverages in order to grow, learn and maintain good health. Students shall be provided with adequate space and time to eat meals during the day.

Children’s Online Privacy Protection Act (COPPA)

Under federal law titled Children’s Online Privacy Protection Act (COPPA), websites must provide parental notification and obtain parental consent before collecting personal information from children under the age of 13. The law permits school districts to consent to the collection of personal information on behalf of all of its students, thereby eliminating the need for individual parental consent given directly to the website.  A list of the possible sites used in our classrooms, with links to their privacy policies and terms of services, is available here.

The Family Educational Rights and Privacy Act (FERPA) affords parents and students over 18 years of age (“eligible students”) certain rights with respect to the student’s education records. Copies of the student records plan shall be submitted to the Department of Education, upon request.

Integrated Pest Management

The district shall utilize integrated pest management procedures to manage structural and landscape pests and the toxic chemicals used for their control in order to alleviate pest problems with the least possible hazard to people, property and the environment. The district shall integrate IPM education into the curriculum in accordance with relevant academic standards. McKinney Vento Homeless Act

The Education for Homeless Children and Youths (EHCY) program, authorized under the McKinney-Vento Homeless Assistance Act (McKinney-Vento Act), is designed to address the needs of homeless children and youths and ensure educational rights and protections for these children and youths. Open Records – Right to Know

The Right-to-Know Law is Pennsylvania’s open records law. It requires government agencies in the Commonwealth to provide access to and copies of public records. You can read more or view our Board Policy.

Protection of Pupil Rights Amendment (PPRA)

This policy sets forth guidelines regarding the conduct of surveys and collection and use of information for marketing purposes, consistent with law and regulations. Personal information means individually identifiable information, including a student’s or parent’s/guardian’s first and last name; home or physical address, including street name and the name of the city or town; telephone number; or social security number.

Public Complaint Policy

The School Board welcomes inquiries, suggestions, and constructive criticism from parents/guardians, district residents or community groups regarding the district’s programs, personnel, operations and facilities. The Board has adopted procedures for seeking appropriate resolution to complaints. For more information on the procedures, here is our Public Complaint Policy.

School Health Act

In accordance with the School Health Act, Pennsylvania requires immunizations and examinations for students. In order to safeguard the school community from the spread of certain communicable diseases, the Board requires that established policy and administrative regulations be followed by students, parents/guardians and district staff.

Special Education

The district is required to provide a free appropriate public education (FAPE) to children with disabilities who are determined, through the evaluation process, to need special education and related services under IDEA and 22 Pa. School Code §14. A school age child with a disability, who is determined to be in need of special education and related services, is identified as a child with a disability eligible for special education in need of specially designed instruction.  For a list of disability categories under IDEA.
